Impact Cleaning Admits Guilt in Lawsuit
Intend to not fully compensate worker on a technicality
In pleadings filed with the Ontario Superior Court of Justice, Impact Cleaning Services Limited (Impact), a cleaning contractor has admitted it owes an employee thousands of dollars in unpaid overtime.
On April 27, 2009, Mr. Steve Singer filed a lawsuit against Impact claiming that between June 2003 and July 2007 he regularly worked in excess of 44 hours per week but did not receive overtime pay as required under the Employment Standards Act. Mr. Singer is claiming over $23,000 in damages.
In its response filed on May 20, 2009, Impact states:
“With respect to the allegations...Impact Cleaning admits that the plaintiff’s usual work hours at both locations were essentially as described in the statement of claim....Impact does not deny that the plaintiff routinely worked in excess of 44 hours per week from June 16, 2003 through July 1, 2007.”
Impact has initiated a payment for a portion of Mr. Singer’s claim but is arguing that it should not be required to pay the full amount due to the passage of time.
In response, Mr. Singer says he will fight for all of the money Impact owes him:
Steve Singer“It makes me angry that they would try to deny me what they owe me based on a legal technicality. I have every intention of fighting for all of the money they owe me.”
Impact's admission that it owes Mr. Singer unpaid overtime comes on the heels of a similar complaint filed by former employee Naser-Eldine El-Sanadli who says the cleaning contractor owes him over $16,000 dollars.
